Garage Built on Telephone Easement Receives Fine


June 4, 2010 – The City of Thunder Bay has received notice that a property owner who chose to ignore information given to him as part of a building permit issued by the City's Building Division was fined $2000 in court this week.

The fine was for the offence of not building in accordance with the regulations for which a building permit was issued. It was found that 16 to 18 inches of telephone line runs underneath the garage. The property owner was directed to remove the portion of garage that was illegally constructed on the easement and in contravention of the City's Zoning By-law.

“We anticipate receiving full cooperation from the owner,” said Mark Smith, General Manager – Development Services.

At the request of the owner to extend the compliance date, the City is allowing three months to comply.  Failure to meet that timeline would result in another court appearance and likely a more substantial fine.
