Notice of Adoption and Passing
City Council adopted Official Plan Amendment No. 16 - By-law 275-2024, and City Council Passed a By-law - 296-2024, adopting the Housing Community Improvement Plan on the 22nd day of July 2024 for the City of Thunder Bay.
The Official Plan Amendment and establishment of a Community Improvement Plan are exempt from approval by the Minister of Municipal Affairs and Housing and the decision of Council is final if a notice of appeal is not received on or before the last day for filing a notice of appeal. The last day for filing a notice of appeal is August 21, 2024.
How to appeal a decision:
Individuals, corporations and public bodies may appeal to the Ontario Land Tribunal (OLT) in respect of the decision by completing the Appeal Form A1 available from the OLT website at www.olt.gov.on.ca/forms and submitting it to the City Clerk no later than the 21st day of August 2024.

The Appeal Form A1 must set out the reasons for appeal, accompanied by the prescribed fee ($1100.00, certified check or money order payable to the Minister of Finance).
Purpose and effect of amendments
The purpose of the Official Plan Amendment No.16 (By-law 275-2024) is to amend the City of Thunder Bay Official Plan, as amended, as it applies to the entirety of the City of Thunder Bay municipal boundary, to establish the City boundary as a Community Improvement Project Area (CIPA).
The purpose of By-law Number 296-2024 is to adopt a Housing Community Improvement Plan and to amend the Strategic Core areas Community Improvement Plan.
Official Plan Amendment No. 16 (By-law 275-2024) applies to all City lands and By-law Number 296-2024 applies only to the lands described in By-law 296-2024 and does not affect any other lands. A key map showing the location of the lands to which these amendments apply is shown below.
The subject lands are not subject to any other application under the Planning Act at this time.

By-law 296-2024 and Official Plan Amendment 16 were approved under Section 28(2) of the Planning Act, R.S.O. 1990, as amended.
All comments received were considered as part of Council’s decision-making process. Council has determined that the proposal is consistent with all relevant planning legislation and represents good planning.

Right to appeal
Please note that the rights of third parties to appeal official plan and zoning by-law amendment decisions to the Ontario Land Tribunal have been restricted under the Planning Act.
Only the applicant, the Minister, and specified persons, public bodies, and registered owners of lands to which the plan will apply and who made submissions at this public meeting or who have made written submissions to the City before the plan is adopted, will be able to appeal the decision of the City of Thunder Bay to the Ontario Land Tribunal.
No person or public body shall be added as a party to the hearing of the appeal unless, before the plan was adopted, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
