The Thunder Bay City Council passed By-law 66/2019 on the 17th day of June 2019, under Section 34 of the Planning Act, R.S.O. 1990, as amended.

Public comment has been received and considered and had no effect on Council’s Decision as the application is consistent with all relevant planning legislation and represents good planning.

The decision of City Council is final if a notice of appeal is not received before or on the last day for filing a notice of appeal, July 10, 2019.

Purpose and Effect of By-law

The purpose of By-law Number 66/2019 is to amend the City of Thunder Bay Zoning By-law 100-2010, as amended, as it applies to 1530 Golf Links Road. Specifically, this By-law:

  1. Rezones the property to the “NC3” – Neighbourhood Centre Zone
  2. Defines the following terms as follows:
    1. A “shopping centre” is a place, other than a mixed use building, where 3 or more uses permitted in the applicable zone, are located together for their mutual benefit
    2. A “drugstore” is retail outlet which among other things sells pharmaceutical supplies and associated sundry items
  3. Expands the list of permitted uses to include uses permitted in Section 18.1(d) of the Zoning By-law, as well as “drugstore” as defined above
  4. Sets the minimum landscaped open space to 20% of lot area, including a 3.0m wide strip along all lot lines and a 6.0m wide strip along all lot lines abutting the street line
  5. Establishes a maximum height of 12 metres for a building located within 40 metres of the front lot line
  6. Establishes a maximum height of 15 metres for a building located beyond 40 metres of the front lot line
  7. In the case of an apartment dwelling:
    1. Establishes a maximum number of three buildings
    2. Establishes a maximum number of 120 total dwelling units
  8. Allows more than one main use on a lot
  9. Requires a privacy screen with a height of 1.6 metres along the north interior lot line only 

The effect of the By-law is to permit the construction of three standalone apartment buildings and a shopping centre with three or more commercial units with site-specific development parameters.

This By-law applies only to the lands described in By-law Number 66/2019 and does not affect any other lands. A key map showing the location of the lands to which By-law applies is attached.

How to Appeal

Any person or public body may appeal to the Local Planning Appeal Tribunal (LPAT) in respect of the By-law by completing the Appellant Form (A1) available from the LPAT website and submitting it to:

no later than the 10th day of July, 2019. The Appellant Form must detail the objection to the By-law and the reasons for appeal, accompanied by the prescribed fee ($300.00, certified cheque or money order payable to the Minister of Finance). 

Right to Appeal

Only individuals, corporations and public bodies may appeal a by-law to the Local Planning Appeal Tribunal. A notice of appeal may not be filed by an unincorporated association or group.  However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf. 

No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at the public meeting or written submissions to the council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
