Public Meeting Notice: Proposed Zoning Amendment at 941 Simpson Street

The Public is invited to participate in a Public Meeting, which City Council will be holding on:

Monday, June 27th, 2020, 6:30 p.m. 

to consider a proposed Zoning By-law amendment at 941 Simpson Street.

Due to the current COVID-19 State of Emergency and to comply generally with the direction from the Government of Ontario whereby all organized public events of over 10 people are prohibited, members of the public are invited to view the Public Meeting via live streaming by visiting thunderbay.ca/watchcouncil or via the live broadcast on Shaw Cable and TBayTel community channels, instead of attending the meeting in person. Video of meetings will also be available for viewing following the meeting online at thunderbay.ca/watchcouncil.

Purpose of Meeting:

  • For the applicant to present the proposal
  • For interested parties to express their opinion about the proposal
  • For community input to be used to evaluate the proposal

Purpose and Effect of Proposal

The purpose of the proposed amendment is to amend the Zoning By-law as it relates to 941 Simpson Street. The proposed amendment would:

  • Add home improvement store, retail store, and commercial school as permitted uses within the existing building
  • Recognize the existing 9 parking spaces.
  • Eliminate the requirement for 1 loading space.
  • Establish any other development related proposals

The effect of this amendment would be to permit the existing commercial uses within the building.

The applicant’s site plan and a key map of the subject lands have been provided.

Right to Appeal

If a person or public body does not make oral submissions at a public meeting, or make written submissions to the City of Thunder Bay before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.

If a person or public body would otherwise have an ability to appeal the decision of the City of Thunder Bay to the Local Planning Appeal Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the City of Thunder Bay before the by-law is passed, the person or public body is not entitled to appeal the decision.

How to Participate

Interested parties are encouraged to submit written correspondence and questions prior to the meeting by emailing jkirychuk@thunderbay.ca by 12:00 p.m. on Wednesday, July 22nd, 2020, instead of attending the meeting in person. Please quote the file number, Z-01-2020, in your submission. All emails will be forwarded to City Council and to the applicant. All comments received will become public information. This means that any information provided in written submissions, including names and contact information, will become part of the public record.

If you wish to make a presentation at the Council meeting, please submit your request in writing to jkirychuk@thunderbay.ca by 12:00 PM (noon), Friday, July 24th, 2020. Electronic participation by the public will be facilitated using Microsoft Teams video communication software or a teleconference phone line. The Clerk will make this option available to participants who have registered by the deadline noted above. Registered participants will be encouraged to participate from home. However, a public computer kiosk with the required software will be made available in the Lobby of City Hall for those who are unable to participate from home. Physical distancing will be observed and sanitization of the computer kiosk will take place in between each user. All use of this computer kiosk will be by appointment only.

All registered participants will be assigned an appointment time in advance of the meeting whether they are participating from home or from the public computer kiosk in City Hall. Appointments are to be arranged through the registration process noted above. Participants shall have a maximum of 10 minutes each. This is to ensure that appointments can be made in a timely manner and that the regulation for public gatherings can be managed at all times.

Additional Information

If this notice has been received by an owner of lands which contain seven or more residential units, please post this notice in a location which is visible to all residents living on the property to which this notice applies.

At this time there are no other applications, under the Planning Act, pertaining to the subject lands.

The report and proposed amendments that will be considered at the public meeting will be made available for viewing on Wednesday, July 22nd, 2020 online at thunderbay.ca/agendas.
